Evidence-of-Use Investigation
The Evidence-of-Use Investigation is a three-part investigation to locate related patents with multiple similarities to the patent of interest, document the similarities, and perform research and analysis of technical literature to determine if any of the Assignees’ current products might utilize the claimed elements of the patent. This comprehensive study is designed to bevery focused and provide more relevant resultsthan a “keyword only” search.
•Part 1: Focused Citation Analysis
The Focused Citation Analysis is an investigation and analysis of Patent Groups 1 – 4 (shown below). The front page of each patent and patent diagram are reviewed in order to determine if it has multiple elements that are similar to the Patent of Interest. Those with multiple similarities form a Final Working Group of patents.
Group 1: Patent of Interest prior art patent citations
Group 2: Patents citing the Patent of Interest as prior art
Group 3: Patents citing the Groups 1 and 2 patents as prior art (and filed after the file date of the Patent of Interest)
Group 4: Patents citing the Group 3 patents as prior art (and filed after the file date of the Patent of Interest)
•Part 2: Technology Claim Diagrams
The Technology Claim Diagrams are detailed documentation illustrating the key elements of each independent patent from the Patent of Interest and how they are similar to each product and/or patent from the Final Working Group Assignees.
•Part 3: Patent Technology Utilization Research and Analysis
The Patent Technology and Utilization Research and Analysis is a detailed technical literature search to determine if the Assignees from the Final Working Group have any current products that might utilize the claimed independent elements of the patents in the Final Working Group. The search includes a review of the Assignees website, and keyword and key phrase searches utilizing data developed from the Patent Technology Evaluation and Focused Citation Analysis.

Evaluations and Evidence-of-Use Investigations are intended to support patent
valuation programs, first level infringement investigations, and competitive
intelligence investigations.
oResource
utilization is based upon specific work requirements, and not all databases and
search engines are utilized for every project.
oAnalysis is
focused on technology, not legal, aspects of invention
o Although a wide
variety of research resources are utilized, results are not intended to fulfill
the requirements of an all-inclusive Novelty, Validity, or State of the Art
Search.
